I have not heard of a BF31, but from what you have written, you have already received it.


Just to clarify, the BF31 I received is not a form, it was just printed on the bottom left side of the pages telling me they had rejected my MR appeal and that before I could I could appeal I had to do an MR.

Yes, I "got" that ! :)

The fact that the letter had BF31 printed at the bottom left of the pages would imply that BF31 is some sort of DWP pro-forma documentation that is used for a particular purpose.

As Gordon implies, it seems clear that they are deliberately giving you "the run around" in an effort to delay or put you off getting to The Tribunal Appeal stage.

At present, The DWP seem to be willing to : try anything to stop the claimant appealing.

Hi Bro.

They are definitely trying to either delay or put me off. They have blatantly lied to me. I've even asked them about the lies. The last person to call me I asked why I've been lied to, he said that he doesn't think they actually lied, maybe it was a misunderstanding. So I said, on such and such a date I phoned, the woman I spoke to told me that a notice of MR had been sent the day before. That was a blatant lie. Then when CAB phoned I was promised a notice of MR within the next 6 days. Another lie. I would like to have another chat with said gentleman as he promised that someone would phone me on Wednesday, I'm still waiting.

Thought I'de update you on what has happened.

I phoned again and told them that unless my notice of mandatory recon was sent within a week I would be going to my MP.

Two days later it arrived.

I went to appeal. The doctor asked me a couple of questions, the judge never asked any. I was in there for about 15 minutes when they told me to leave the room. The man from CAB that accompanied me couldn't understand what was happening as this had never happened in any of the appeals he had been to. About 10 minutes later (which felt like 2 hours later), I was called in to be told that together with my answers and my consultants report I have won my appeal at the higher rate.

The most amazing thing about all this is when I got all the paperwork from the dwp for my appeal, the person at Atos who did my examination thingie had given me no points whatsoever.

So according to him there is nothing wrong with me. The decision maker who had never met me then gave me enough points to put me into the work group.

So thank you for your help.

Congratulations on the award.

The PIP Decision process does seem to have taken a dive into darkness since they stopped the auditing of reports.

Thanks Gordon.

That was my ESA appeal not PIP. I have subsequently done a PIP claim and assessment. Within ten days I had a reply back giving me the higher rate in both the mobility and care bits.
