Hi,
I am receiving income related ESA and the standard rate of PIP daily living component.
The DWP sent me an application form for Severe Disability Premium. When I looked into the conditions I found a number of publications which say that one of the criteria is to be living alone OR "can be treated as living alone". AgeUK fact sheet 81 says " You can count as living alone even if you share your home with other people. The following people can be ignored when deciding if you are living alone ; Anyone who is not a close relative and is a joint tenant or co owner with you" This is my position, I jointly own my house with an unrelated adult.
I spoke to the DWP this morning but they said this is not the case and as another person lives in the house (although we are not partners or living together) I do not qualify for SDP.
The rules on "treated as living alone" seem pretty clear to me but the DWP said this was nonsense!
Am I right and do I have a case to appeal this decision?

I am assuming that you called the ESA hotline and only spoke to a call responder!

I am afraid these people often have a limited knowledge of how benefits actually operate and more importantly have no decision making authority.

Fill in the form and return it, a qualified Decision Maker will look at it and decide whether you meet the conditions for living alone or not and therefore whether the premium is payable or not.

If you are still turned down then come back to the forum and we can explain how you can challenge that Decision.
