I too worked in LA, however I was retired due to ill health in 1999 after trying to stay at work after having a RTA in 1996.
The OH signed me off for ill health retirement in 1999, however then they did not use the tier system and in fact was placed on IB via a meeting with DWP, OH,LA HR, which meant I lost out on a pension from the LA - cost cutting excercise at that time.
It meant in reality that my IB and DLA was to replace any pension, at the time it seemed fine, however in hindsight and the changes from IB to ESA and future PIP means I am well and truly stuffed.
I did contact my LA in 2011 and was told they were not interested as it was over 10 yrs since I was retired due to ill health and no records in existence.
So this is why I said please look at your case with the LA properly so as not to lose out financially as I did.

sheeps68- will have to have a look at your posts, do you mind me asking what you were retired with.
I am just filling in the ESA1 form in and I dont know what to put for Part 5 when it says "Are you going to go back to work and if yes when.
What do I put, I dont know if i will, i am due to try some needles in my back- it might cure me, but then if i tick yes it says when, well i dont know.
Could any one help me as to which one i tick

This question is related to what your doctor has said, based on your posts I would reply "no", because at this times you have no specific plans to return to work.

Hi mrsboop. I have brittle asthma that has taken over [or tries] my body and life. Sounds nothing does it. I so wish it was true.

Came back to give everyone an up date.
I went to the doctors and saw my usual one, i told her that another doctor within the surgery had told me that i had fibromyalgia and that i had not been told this before.
she went through my recoords and said there was no diagnosis of fibromyalgia and she did not know who had put it on the system.
Hr came out again this week and they told me they were waiting for a medical report from my doctor (which i will see first) so they could retire me on ill health so i would get my pension.if i did not qualify it would be dismissal on ill health grounds.
Anyway i told her what the doctor had said and she scribbled it down.
the next day i got a call from the hr lady and she said she had spoken to the head and because i did not have fibromyalgia i would have a meeting next week at home and it would be my final one and will be dismissed.
i think they trod lightly when they thought i had a disability of fibromyalgia, but now i dont they are going to just get rid of me.
my problem is that under disability act chronic fatigue is disability so is back pain, im not sure of chronic pain.
i told my union rep this is all too fast and in a week they will finish me. i want to claim for bullying and harrassment and victimisation. he said if i want him to contact hr he would but i would have to tell him i want this.
im a mess the doctor has already put me on depression tablets, i cant cope with all this. i had an enoscopy yesterday so i am not well, diagnosed with an hiatus hernia and they took a biopsy as i had inflammation that they wanted to look at as well.
Any advice would be welcome

Hi mrsb,
I am afraid that we cannot advise on any issues to do with your employer/employment.
Your Union Rep would be best placed to do that, and if necessary they could enlist the support of a Union Employment Law Solicitor for you.
