means tested benefits was created by Tommy Miner
can dwp transfer you from contribution based esa support group onto a means tested benefit with immediate effect ie straight away or are you allowed to be placed into the work related activity group for the first 365 days first before being placed onto a means tested benefit and if the dwp can place you onto a means tested benefit immediately can you explain under what circumstances can they do it and what can i do to get onto a non means tested benefit thanks again much appreciated tommy

Hi TM,

If you are entitled to CB ESA in The SG, you will continue to receive CB ESA for as long as you remain in The SG. (There is no time limit whilst in The SG)

If as a result of a future reassessment you were placed into The WRAG from The SG, you would receive 365 days of CB ESA payments in The WRAG before CB ESA payments would cease.

You would then need to be financially assessed to see whether you could pass the means test for entitlement to Income Related (IR) ESA payments.

If you had no entitlement to IR ESA payments, you would not receive any monies, but you would continue to receive NI Credits which would go towards your State Pension entitlement.

This is classed as being entitled to CB ESA payable at nil rate.

On the premise that you kept your ESA claim open as above, (NI Credits only) if your conditions then changed/deteriorated to such an extent that you reported a Change of Circumstances, (C of C) and as a result of this you were placed back into The SG, payments of CB ESA in The SG would be reinstated, and remain in payment for as long as you stayed in The SG.

The same would apply if you were placed back into The SG at some future reassessment.

A claimant who is in The WRAG in receipt of NI Credits only (nil rate) cannot be compelled to take part in Work Related Activity. (WRA)

So basically the answer to your question is "No", The DWP cannot simply change your non-means tested CB ESA over to means tested IR ESA.

As long as you have entitlement to payment of CB ESA, CB ESA payments will continue.
