Tryimg to move form Income Support to ESA was created by brokendown
Hi There
My sister in law is on Income Support and last year tried to move to ESA but did not get it. She has been advised to apply again but is fearful as she was without any benefit for 3 months because of her application and she is fearful this is going to happen again. She suffers from Chronic Epilepsy, Depression, Anxiety, Photophobia, high blood pressure etc. What should she do?
She is trying to apply for PIP but has been told there will be at least 26 week wait?

Did she not appeal the Decision to refuse her ESA, if it was less than 13 months ago then there is still a chance that they will look at the Decision again.

If she would rather make a new claim then she must do so before 30 March or she will need to show that there has been a deterioration in her condition for the DWP to accept a new claim.

New PIP claims are being handled a lot faster now, but it is still possible that it could take the best part of 26 week before they receive a Decision.

Thanks lots.
Can I ask why they stopped her Income Support when she applied for ESA, she was without any benefit for 3 months Income Support etc, will they do this again?
Her condition has got a lot worse and we are trying to apply again as soon as possible.

If your sister in law was receiving Income Support due to Incapacity then she should have continued to receive IS until a Decision on her ESA claim was made.

If she was receiving IS for another reason then she would have had to close her IS claim before the DWP would have accepted a new claim for ESA, but this should have only required one day, however, there is a waiting period for ESA which is now 7 days and it can take a couple of weeks before ESA goes into payment, although this is backdated to when the claim is made.

Thank you so much.
Last time she had no IS for 3 months, she is claiming IS as she cannot work due to a chronic condition. So hopefully now she will be able to get ESA and not be without money for very long, a real worry.

If her previous IS claim was closed which would be the only way that she could make a claim for ESA, then she cannot make a new claim for IS Due to Incapacity, so if she is receiving IS at the moment it is for some other reason.
