ESA Support group

I am wondering if anyone can help me? I am working with someone who receives income related ESA in the support group. She has savings of over £16k and is fearful that she will be asked to repay what she has received. I am sure that I have been told that in the support group it does not matter how much savings you have, but I cannot find anything about this online.
Can anybody help?

Hi A,
Welcome to Benefits and Work

You can do "Permitted Work" whilst in receipt of IR ESA (or CB ESA) in The Support Group (SG).
However, The DWP should be made aware of this, as only they can decide whether the work should be classed as : "Permitted Work".
There are restrictions on what you can earn whilst doing "Permitted Work" see further information on this from the link entitled Permitted Work, 5th link down this page :

As ESA is an "out of work benefit", work other than Permitted Work may preclude payment of any ESA at all.
With respect to the second part of your question regarding savings in excess of £16,000 !
Being in The Support Group is not relevant to any savings that they may have.
The important issue is whether they are receiving Contribution Based (CB) ESA in The SG, Income Related (IR) ESA in The SG, or both CB ESA & IR ESA top-ups in The SG
If all their ESA payments are made up of CB ESA only, there is no savings limit.
If any part of their ESA payment is IR ESA, there will be deductions for anything in excess of £6,000, and once in excess of £16,000 all payments of IR ESA would be precluded :
Asset rule for ESA(IR)
&
24 hour work rule for ESA(IR)
As you can see, their are several different scenarios, so just because someone may be working whilst in The SG, whilst also having in excess of £16,000 in savings does not necessarily mean that they are breaking any rules.
If your colleague has any doubts, they should seek advice :

It is not really ideal giving advice to someone regarding the personal and financial circumstances of a colleague at work, as you may not be privy to all their personal details.

Hi Anne,
My colleague has pointed out that I may have misinterpreted your statement :
" I am working with someone who receives income related ESA in the support group."
Is the person that you mention simply a work colleague, rather than someone you are "working with" in an advisory capacity.
Can you clarify please ?

I have tried to point you to the different scenarios of someone in The SG being also able to work as long as it is "Permitted Work" whether they receive CB ESA, IR ESA, or both.
If they are definitely in receipt of IR ESA, and have in excess of £16,000 they should not be receiving any amount of IR ESA.
If the work that they are doing is not classed as "Permitted Work" and they are simply "working" then as with the savings issue they may have problems if the DWP have not been informed.
Either of the above, could mean that they have been receiving overpayments, and they may have to pay all overpayments back, as well as suffering Penalties or Court Action.
