Not entitled to pip, scored 0 on all 12 questions, even though I am on medication for severe anxiety/depression & I've been put on a 6 week course for counselling. Works/pensions called me at home as I requested a reconsideration to their decision, she went through all 12 questions and told me that the interviewer made her own assumptions with notes, noting that I had good eye contact, understood & answered the questions correctly. Yet she did not include what I told her about how it affects me everyday. Apparently, only the 12 questions are important & how I deal or cope deep down with this disability has nothing to do with the 12 questions! I followed benefits/ work guidelines to prepare me for this interview, unfortunately the guidelines are not the same as suggested when in the interview. Atos are not interested in listening as to how my anxiety/depression affects my life!!

I am so sorry that your PIP assessment did not go in your favour :( Are you going to request a Mandatory Reconsideration? There is information about this in the PIP guide you referred to.

Hello, thanks for replying. Firstly, showing my name on the this forum is the least of my worries. I'm annoyed the way Atos have gone about with their 12 question pip interview, just 2 days ago I had another call from work/pensions, asking me again if I wanted them to reconsider the pip decision & telling me I only have until the 17 April '15 to do so. I told him I've already had this phone call, he suggested I get more evidence, i.e, letter from my GP, go see citizens advice, see what they can suggest. Well that's all very good advise but I would have thought Atos have already received info from my GP, that's what I was told by the Atos interviewer also citizens advice cannot go over the heads of Atos when they have to stick to the 12 questions and are not allowed to submit any other information concerning your illness. The man from work/pensions said to me that he did not know if citizens advise could even help me with my case. I've lost all faith in trying to continue with this reconsideration, I would be fighting a losing battle, limited time in getting further evidence, having to pay for a letter from my GP, trying to get an interview with the CAB immediately, they are always back logged with appointments, I'm under enough stress & pressure as it is coping with my anxiety/depression, thank goodness for the free psychological therapy counselling sessions that are booked for me!

The 12 "questions" are defined in the PIP legislation and are the only criteria against which a claimant can be assessed, there is no discretion for the assessor or the DWP Decision Maker to look at anything else.

If you feel that you meet these criteria, sufficient for an award then your only way forward is to make a formal request in writing for a Mandatory Reconsideration to be done, if you do not feel that you can qualify under these criteria then you may have to accept that you cannot qualify for PIP.

You should not assume that the assessor has contacted your GP for more information, they may have but there is no legal requirement for them to do so and in the majority of claims they do not!

Am so sorry that you have been treated this way i really am.. :(
I just wanted to say that a friend of mine (he is only 18) applyed for the same thing, and for the same medical condition you have, and got DLA for 10 yes 10 years! I think thats disgusting that you have been treated the way that you have, and even though my friend did an interveiw i think its wrong to give a boy of this age DLA for ten years, what insentive will that give him??
This system is just not right, i think they just make there own minds up i really do...i would get it looked at again, keep fighting for what you are owed, never gove up!
