I claim DLA but my ESA was stopped Dec 12 I did appeal and the appeal was allowed with WRAC component. Then I was told that as I had already claimed for over 12 months it would stop.

As my wife works 30 hours we cannot claim ESA income based. My condition is still unchanged.

Now I have been sept an appointment for an assessment for next week but no ESA50.
I am puzzled why they need to assess me-would it be for DLA which was awarded indefinitely.
Any one any ideas ?

Although you are no longer receiving ESA payments you are still entitled to NI Credits which count towards a full State Pension as you are still being classed as having Limited Capability for Work, also while you still have this status, if your condition deteriorates and you can show this, then you can ask to be re-assessed for the Support Group and if successful your ESA(CB) will go back into payment.

If you don't attend and pass the assessment then you lose you LCW status, the NI Credits and your ability to claim ESA(CB) again without your working.

As you have received no ESA50 you should contact Maximus and ask for the assessment to be postponed at no fault to you so that you can complete an ESA50, they have recently told us that all claimants should receive an ESA50 as part of a re-assessment.

The Centre for Health and Disability Assessments.(CHDA) (Maximus) who took over the ESA WCA Contract from ATOS on 02/03/15.

Many thanks for your reply I will contact Maximus and request ESA 50.
My condition is getting worse I am 58 years old and have now developed a 2nd condition which may or maynot been connected to the original spinal problems which has left me difficulty walking/standing etc.
Would anyone know if I should put the new condition on the ESA50 (as I have seen a consultant and am now waiting on a scan before he can determine what treatment is needed) or leave it off as I didn't want to muddy the waters.

If this new condition is affecting your limitations in context the ESA Descriptors then you should include it on the ESA50, if you do not, then the assessor and the Decision Maker cannot take any account of it in their review of your information.
