Assessment appointment.

They suggested I download a copy,complete it and take it with me. They cannot postpone appointment as I had to postpone it once before as my wife was unable to get time off work to accompany me.
So I will attend tomorrow with my downloaded ESA50 and see what happens.

The DWP do not issue the ESA50, this would be done by Maximus.

As I could not defer the appointment (as I had already changed it once) I downloaded the said form it took it with me.
When I arrived I explained to the accessor and he said they had already held an ESA50 on my file.When he opened the file I noticed the date was 2013.
He did accept the new form and transferred the information on to a computer screen.
After the 45 minute appointment I now have to wait to see If i cannot still get nothing,just my NI credits.
Seems a complete waste of time and effort.

ESA Decisions are usually quite quick so I would expect you to have a Decision Letter in the next couple of weeks.

During the last appeal in 2013 I scored 15 points.
My condition has not changed and in fact this time I had a new problem.
As I don't receive any ESA money only credits they told me they could transfer me on the telephone so I should go on to JSA to receive credits.
I declined as I thought I would give it some thought. She said I had a month to decide.
I dont want the stress of another appeal and wondered if anyone could advise by not going onto JSA would it affect my DLA and Tax Credits.

There is an extra factor that you may need to consider.
I assume that you were in the ESA WRAG and your payments were stopped due to the 365 day limit and this is why you were only receiving NI Credits.
First I assume that you checked to see whether you were eligible for Income Related ESA which is not limited?
If you do not challenge this latest Decision then the only way that you will be able to reclaim ESA at some point in the future will be if you re-establish your NI Contribution history, this can only be done by being in paid employment or registered self-employment.
If do challenge the Decision and win, even if your payments do not start you retain the right to be re-assessed for the Support Group should your conditions deteriorate or you develop a new one and if successful, your ESA(CB) will be re-instated.
We don't advise on JSA so it is difficult to offer advice, I have done a quick search and whilst I cannot find a definitive source for the information it appears that you might be required to "sign on" regularly to be eligible to continue to receive NI Credits. It's probably easiest to ask the DWP whether this would be the case or not and whether there would be other requirements placed on you.
Also, JSA(CB) is limited to six months normally, I'm not sure if this applies to Credits Only claimants.
Your DLA will not be affected, although you will be transferred to PIP at some time in the future.
Tax Credits are dependant on Taxable income, so I can't see why the situation would be any different under JSA than it has been under ESA if you are not entitled to payment.
