Apologies in advance for typos etc

I am in receipt of Income support still, was sent a form a few years ago which i sent back with letters from all my specialists etc. And have not been recalled for anything since.

I am also on high rate mobility and care DLA

I have an incurable life limiting illness and might be assed for a transplant soon but this won't cure my illness it just replaces the worn out liver which is being destryoed by my immune system. I will still be ill and the new liver will end up wearing out too.

I ahve recived a letter today from Health assessment advisory service to say i have to go for assessment but no sure what its for.
Would this to be assess me for JSA? Instead of income support? Or is it to do with DLA>?

The appointment was set for 9am and I ranf to tell them i couldnt make that time as it takes me a while to get up in the mornings, the man was very rude told me i could only change it once and so i was too scared to ask him another question about what the interview was for.

Can anyone advse?

Hi as,

Welcome to Benefits and Work :)

If you receive Income Support due to your incapacity for work, it is most probably to migrate you over to ESA.

If your letter is from : The Centre for Health and Disability Assessments (CHDA) (Maximus) who took over the ESA WCA Contract from ATOS on 02/03/15, then this indeed would confirm your migration to ESA.

Assuming the above to be correct, have you received an ESA50 Questionnaire to fill in and return ?

If not, you should have !!

See two recent News Articles regarding the issue of CHDA (Maximus) not sending an ESA50 to the claimant : Here, and Here.

If you haven't received one you need to challenge CHDA/Maximus as advised.

You can even quote our two News Articles above.

You are allowed to rearrange your appointment once which may give you chance to challenge not being sent an ESA50 Questionnaire prior to a face to face assessment.

As advised, you should fill in an ESA50 and post it to maximus, and/or take a copy with you to the "medical" if/when you eventually have to attend.

You can get an ESA50 by downloading and saving the Pdf version from the link on this FAQ : Using The PDF Version Of The ESA50 Questionnaire

You should fill it in whilst referring to the applicable guides 3rd and 4th links down this page :

ESA Claims Guides

As you will see, there is also guidance on being transferred over to ESA from the top link on the same page.

If you fail to attend any rearranged appointment, that being the case, your benefit payments may cease unless you can show "Good Cause" for non attendance.

In preparation of having to attend an ESA "medical" have a look at the following FAQ: ESA Medical – What to expect

From our : ESA FAQ’s

See also : IB, IS, SDA, Migration to ESA FAQ’s

If the "medical" assessment is not with CHDA, (Maximus) then it will not be for transfer to ESA, in which case you should let us know.

I know this will be a lot to take in, so you might want to Bookmark/Favourite this page in your internet browser.

You can then return to it easily for future reference and/or to pose any further queries that you may have by replying to the topic.

I suspect this might have been the ESA50

If it is an ESA50 MHB, although angelsew states :

"I ahve recived a letter today from Health assessment advisory service to say i have to go for assessment"

They should fill it in and return it by the deadline date provided.

(They can still use the Pdf version)

angelsew, it might be worth you downloading an ESA50 as bro has said. You can take it with you to your assessment.

I see MHB,

If the form that angelsew was sent and returned a few years ago was in fact an ESA50, they can still challenge CHDA (Maximus) as the information provided within The ESA50 will not be current, as advised in both News Articles.

They should still fill in a current ESA50.
