Hi Gordon, I rang to ask about re assessment and was told a date but that they have never heard of an ESA85A !!!, not sure what to do next, just wait for re assessment and fill it in or is it worth filling in the Subject Access Request (SAR), if so do i tick both computer and clerical records for ESA & DLA ? also should I mention ESA85A needed ? also part D Dates, his ESA for two years is assessed late this summer and DLA was for life, how far back do I go for the Personal information required for period ?, sorry for all the questions but thank you again.

You will have to raise a SAR.

Personally I would not bother with the computer records , they rarely reveal anything of consequence.

Yes you should specifically mention the ESA85.

You can either ask for specific information or all of the information within a specified period, as you are only interested in how you qualified I would ask for the all of the documents used in the making of the Decision date dd/mm/yy.

ok, I Will fill out a SAR, I presume that I just take it to my local DWP/jobcenter and not need to post anywhere specific ? thank you so much.

Hi C,

You can use a SAR Form :

SAR Form Download

From this page :

DWP Data Protection Policy

Or you can make the request in the form of a letter, as long as you make it clear that you are making a formal SAR under The Data Protection Act 1998.

Address the envelope : FAO The Data Controller, at the address of the Benefits Office on your most recent ESA letter.

Write DPA 1998 SAR in front, top, left corner of envelope.

Once received, they have 40 calendar days to comply.

Sending Documents to the DWP.

Hi bro58, ok would sending a letter to The Data Controller, at the address of the Benefits Office on your most recent ESA letter be the more Direct/quicker/best way rather than take it to local jobcenter [ I presume they would send it on to Data controller anyway ?].
Is it possible to just fill out the SAR Form and then send it direct to the Data Controller, at the address of the Benefits Office on your most recent ESA letter with DPA 1998 SAR in front, top, left corner of envelope.
