Hi,
I wonder if anyone can help or give me some advice. I was initially refused PIP, but did a M R and was awarded the Standard Rate of the Daily Living Component. My CAB advisor felt that the decision was still wrong, as I was not awarded anything for Mobility, and she felt that even the Daily Living Component was wrong. I have Mental Health issues, and yet my assessment was carried out by a Physiotherapist!!!
But my question is: I have now appealed to the Tribunals Service. I received a letter dated 16th April, telling me that the Courts & Tribunal Service received my appeal notice on the 8th April. They have asked the DWP to prepare a written response. What I am asking is: how long is it likely to be before I get the written response from the DWP?

The DWP have one month form the date of the letter that the Tribunal Service to prepare and submit their response, you'll receive a copy of this and should have one month from the date of that letter to prepare and submit your papers. In reality it may be longer than this as appeals are taking a while to be heard in most parts of the country.

You can continue to submit evidence up to about two weeks before the hearing and if necessary a single page on the day of the hearing.

Thank you for your reply Gordon. I feel that I am being fairly stupid asking silly questions, but is it a month from the date of the letter that the Tribunal Service sent to me, i.e. 16th April, or a month from the date that the Court received the appeal i.e 8th April, that the DWP have to respond, and what happens if the DWP do not respond in that time.

It's one month on the date of the letter you received, a copy will have been sent to the DWP.

In the vast majority of cases it only takes the DWP a few days to get together everything they will include, using standard templates, it is only a few cases that will actually require any significant input from them. If they are late and we have seen this a few times recently then the court will write to them reminding them that they need to reply, this may happen several times. There is nothing really that you can do about this, the process has to be seen as fait for both parties.

To re-iterate, it is very unusual for this to happen.
