Hello
I recently got awarded 8 points at tribunal, some points awarded by DWP were taken off and others awarded. I was speechless at the verdict, I knew I should be pleased but I was confused, what did they not believe? I felt hurt at not being understood. A strange feeling, I find hard to describe. Overall it was a feeling of not being believed. Probably because I have a severe condition which is misunderstood and I often feel like I have to explain myself and Im fed up of it.
I wrote to Tribunals service to ask for a statement of reasons.
a/ because I wanted to understand what reasons I had been awarded the points. The verdict was a bit of a blurr.
b/ I thought info this would help when my award runs out. I guess I have to reapply. Any advice on this would be appreciated.
c/ who knows. . worth having in case I decided to go to upper tribunal at some point. Doubt it but if I don't have the info I can't.
The tribunal service phoned me up and advised that if I was to receive this info the DWP may take this to the upper tribunal and I may not receive this award as DWP automatically get a copy if I request one. I was stunned at the time, I guess it was good advice but I'm not sure what to do now. I have to let them know very soon whether I want the statement of reasons sending or not.

Requesting a Statement of Reasons from the Judge of an appeal is the first stage to lodging an appeal to the Upper Tribunal, whichever party makes the request, the other will receive a copy and if this results in a challenge to the Decision then any award that the Tribunal may have been made will not be payable until the matter is resolved.
It is not our policy to offer specific advice to claimants on the forum, but in this case I am going to break the rules, withdraw the request immediately!

Thanks Gordon, I think I have got confused. I seemed to think it was quite a standard thing to do and that it may help me understand how my case was perceived by the law. I will withdraw my request immediately as advised.
