PIP Mobility backdating was created by DA0
Hi,
My brother was in receipt of lower rate DLA care. His overall health deteriorated and he duly notified the DWP of this change on 10th Nov 2014. He was sent a PIP application, completed it with my/B&W help, and submitted it.
He has now, after an ATOS consultation 5 weeks ago, been awarded PIP Daily Living AND Mobility, both at the standard rate.
Now I completely understand that the Daily Living element is not backdated (as it would if it had just been a fresh PIP claim (no prior DLA)), as he continued to receive DLA care payments.
However, the DWP have not backdated the Mobility element, despite their own finding that he has mobility needs, and has done since 10th Nov 2014 (6 months from application to award decision).
Please advise if he is entitled to the PIP mobility being backdated.
Of course, the good news
is that he is now going to be getting his appropriate PIP payments in the future. Until the rules change again anyway
.
Keep up the excellent work, and thanks to all the B&W moderators, staff and contributors, for helping me help my brother.

Congratulations on your brothers award.
I am afraid the PIP legislation does not allow any backdating of an award when a claimant has been transferred from DLA to PIP. The increased award will only apply from the date that PIP has been awarded.

Thanks again Gordon.
Much as expected.
On a upbeat note:
I should have stated that his PIP award is slated for review in 2021.
Not an indefinite, or lifetime award, but 6 years
nonetheless.
Are the DWP realising that there are long term claimant problems that it's a waste of time and money (theirs: Atos, Maximus, etc, and ours: ill people, their relatives, CAB, taxpayers etc.) reviewing too frequently?
Longest I've heard of, and it will hopefully spare him future hassle and let him focus on his health.
I hope many others start reporting lengthy award review timescales.
Much as expected.

Hi DA0,
We have already heard from some members who have received "Ongoing" PIP Awards which is the nearest equivalent to a DLA Indefinite/Life Award.
