A client recently lost an ESA Tribunal appeal and is now putting in a new ESA claim. DWP have told him that the rules on reapplying have now changed. Is this true?
Since 30 March 2015 you can only make a new claim for ESA on the basis of a new condition or a deteriorated condition which has the potential for an award, the claimant will be sent a form asking them to explain the change. There should be no problem with a new condition providing it is listed on the new Fit Note, however, it is at the discretion of a Decision Maker whether they allow the deteriorated condition.
