Hi there, just a bit of info I need if you can help, I am waiting for a date for my tribunal hearing for pip and just wondered if its worth sending any more medical results after having more tests. I have osteoarthritis in all major joints and are having on going treatment and tests. Ive just been for a recent MRI scan and got my results, I have been diagnosed with ankylosing spondylitis, I am on new medication and steroid injections and got lots more specialist to see. would it help if I sent my results to the appeals board and do you think it would benefit me if I do. I have also been to see my works occupational health and they say I have to finish on ill health, Its so upsetting to think that atos said that I don't fit the criteria for help when I now need it more than ever. Thanks a lot.

Hi Sharon,

It might help but you will have to show that you would have been suffering the effects of this at the time the decision was made. The Tribunal panel will not be able to take into account any change in your condition since that date.

Hi there, sorry too ask but have asked a few questions on the site before, I have now been diagnosed with AS ankaylosing spondylitis amongst osteoarthritis and extreme wear n tear in all joints, and when I filled in the forms as how does your illness effect you I was still ongoing with investigations and treatment. With this result and now knowing whats causing all the pain and discomfort, do you think they will take it into consideration my claim for pip. got my tribunal date soon and don't know which way to turn, Thank you

Hi s,

Even though the Tribunal will be "re-looking" at "how you were" at the time of the adverse PIP decision and cannot take into account any change or deterioration in your conditions since that time, if you can tie the recent diagnosis into the time of the adverse decision in that the likelihood is that you suffered from these then undiagnosed conditions at that time, you can submit copies of the recent diagnoses as evidence to The Tribunal.

A good indication that you did have these condition at that time would be if your stated limitations within The PIP 2 and at the Assessment itself were consistent with the newly diagnosed conditions.

i.e. The new diagnoses support the fact that it is more likely than not that you did suffer from your stated limitations at the time of the PIP Assessment/Decision.

Ideally copies of any evidence should be sent to The Tribunal no later than 7-10 days before the hearing date.

Hi, I have got the date for my tribunal and feeling a little bit nervous. I have been diagnosed with Ankylosing spondylitis, osteoarthritis, polyalthralgia, and many other things. I am finding it hard to do many things on my own now. When I went for my assessment the answers I gave were nothing compared to the answers in the assment form. All in all he lied about my answers, I was just reading through the pages and would like to ask if you can help me in any way to get the best result for me. Any help will be greatfully appreciated,thank you.

Hi Sharon,

I have merged your 3 topics about this, it makes things easier for us mods if everything is kept in one place.

Have you seen the 'youtube' video which explains what to expect at a tribunal? The vid talks about ESA but it is also relevant for PIP, the difference being that there will be 3 members of the panel.
