Hi Guys,

Just to update those interested in my original question.

I took the advice given in this forum and I did indeed write to my MP, quite a lengthy letter as I included some of my correspondence with DWP as well as explaining my own health issues in brief, or as briefly as I could!

I am pleased to say that I received a phone call yesterday actually, explaining that they had made a mistake and that as my Incapacity Benefit has been paid to me since 1998, prior to 2001 when the changes apply from, my pension should not be included in the calculation of my ESA.

In addition to that, they have changed the review date of my pension until after my retirement age (I am currently in my mid 50's) which will stop me from getting letters from DWP hopefully. I have it in writing from them anyhow so we shall see.

I might add that I receive the Contributory ESA allowance as I still pay National Insurance on my pension income.

Millhouse, In addition to my earlier post this evening and in answer to your question, Yes I did quote the relevant section to both my MP and in my letter to DWP. DWP just took no notice and sent me a spewed out computer generated letter identical in every way to the first I received with no attempt to answer any of my original questions about it.
Hence my letter straight to my MP.
