Hi I've received my award notice yesterday and was extremely pleased to find out I'd been awarded standard rate care. However I got nothing for mobility. I don't want to appear ungrateful but it was a bit odd because mobility is the thing I struggle with the most. What I need to find out is, if I do appeal the mobility element could I end up losing the other part. I don't want to cut my nose off to spite my face. Should I just be thankful I got anything and keep quiet.
We always warn people that there is a real chance of your award being downgraded, or removed, at the MR stage or appeal. Whilst the Tribunal Service have to warn the claimant, and let them withdraw the appeal, if they are considering reducing or removing the award, the DWP do not have to do this before they undertake a Mandatory Reconsideration. Of course, the MR decision is still appealable but no payment would be made whilst awaiting the appeal if the award were to be removed at MR stage.
We usually recommend having a good look at your award to get an idea of how 'safe' it is (although there are no guarantees) but I'm afraid the decision has to be yours alone.
