Thank you. Can I just confirm please that if I send off my appeal forms I can stop the process at anytime.
Would it be wrong of me to send in the forms so that I can see a copy of the DWP documentation used for my case? I believe they have to prepare a pack and I get a copy of it. Can I drop out at this point once I have received my copy of the pack? I really wanted to see it before I decide whether to definitely appeal,

Hi Ec,

Yes, you can cancel your appeal at any time in the process !!

It wouldn't be wrong, however if the only reason for you appealing is to obtain copy of all documentation used in coming to the PIP decision, you can simply make a Subject Access Request. (SAR)

To cover all bases, you could make a SAR for "All" documentation used in coming to The PIP decision.

You can do this using a SAR Form :

SAR Form Download

From this page :

DWP Data Protection Policy

Or you can make the request in the form of a letter, as long as you make it clear that you are making a formal SAR under The Data Protection Act 1998.

Address the envelope : FAO The Data Controller, at the Benefits Office dealing with your PIP.

Write DPA 1998 SAR in front, top, left corner of envelope.

Once received, they have 40 calendar days to comply.

Sending Documents to the DWP.

Anyone can make a SAR to The DWP at any time, they do not need to have any particular reason to do so !

Of course, I understand what you are saying regarding making an appeal within the time limits to protect your rights of appeal and to receive copy of the PIP documents.

I have no representative yet and I am about to send the appeal forms back. Can I add a representative later on after the forms have been returned?

Well, I have decided to appeal and I am sending in the forms tomorrow. Do you have any idea how long it normally takes before the appeal date comes through please? Thanks

Hi Ec,

Once The Tribunal Service (TS) have informed you that they have accepted your appeal, on average you will be looking at 2-3 months before your hearing.

As already stated, you can withdraw from the appeal process at any time by informing the TS in writing.

Please let us know how things are progressing.
