Hello,
I’ve been a member of Benefits & Work for about 3 years now & have found the Guides to ESA & PIP very helpful. However, I have a specific enquiry that isn’t covered in Guides. My question is does Scotland have a different benefits system or variations in its rules for ESA, PIP, Housing Benefit & Council Tax Allwance/Benefit compared to England?

Currently the ESA and PIP legislation is the same for England and Scotland, this may change depending on how powers are devolved to the Scottish Assembly. Housing Benefit and Council Tax are specific to the Local Authority, so there is variability across the whole country.

Very new here but Scottish.... I think where some ...differences are applied are through the mental health act and it's regulations and legal repurcussions. Many aspects of healthcare are also applied differently.There is a difference or appears to be a difference in what is termed in- patient treatment for mental illness.
I am an example of this in terms of assessment for ESA? I did not get sectioned during my breakdown last year but was,released after assessment to family with everyday community support...I was bound to make daily contact with hosps or police would have intervened? As far as I can see this was deemed in-patient treatment in any benefit assessment purposes. Maybe just in Scotland? I was very ill and suicidal at time?
