Hi, am enquiring on behalf of my brother in law whose just been diagnosed with tracheal cancer and at present is still in an induced coma. He's a builder by trade but wont be able to work upon his release from hospt, straight away. Long term, who knows ?Will be under going chemo and radiotherapy the hospt has said. His wife is worried witless about how they're going to cope financially - would he meet the criteria for claiming ESA? If so, it would be income related as he has insufficient NI contributions. His wife doesn't work - just lost her job after the company she works for has folded.They claim housing benefit. Any advice would be much appreciated. Thanks inadvance.

If he is currently in hospital then he should automatically qualify for ESA and should continue to do so if goes on to receive chemotherapy.

If he is receiving Housing Benefit then it is likely that he would be eligible for Income Related ESA.
