From what I have read everyone has been very lucky, my daughter had her assessment for ESA on 29 November 2013 and placed in the support group. In June this year she received an assessment for PIP and received the enhanced rate for both mobility and daily living component. Today she has received a letter calling her for another Health assessment for ESA less than 2 years after the first one! When I contacted them regarding this I was told they cannot use the assessment used for PIP for ESA as they do not share the same computer system!!!!! Has anyone had this problem and any way to overcome this idiotic bureaucratic nightmare.

ESA and PIP are separate benefits with separate criteria, even where they overlap and this is only in a few areas, there are differences. I'm afraid it would be impossible to make a valid ESA Decision based on the report from an PIP assessment and vice versa.

You don't mention your daughter receiving an ESA50? If she did not then she is entitled to complete and return one before her assessment is held.

Thank you for the answer to my query, an ESA50 was completed in October 2012, but she did not attend for an assessment for various reasons until November 2013. She has been called for an assessment in early October, however I have found out today that the assessment in November 2013, which was recorded and no mention is made in the recording only in notes made after the assessment that she would be better in 12 months and would need an assessment then. Surely this should have been disclosed at the time of the assessment so we could have queried the decision ? I have also requested that the assessment be completed at our home because her condition is so variable. This they have refused even though the PIP assessment was completed at home.They have said I must get a letter from her GP but she does not she her GP about her condition plus in the last few weeks we have changed GP and the old GP will not answer letters from HAAS. My daughter deals with a specialist service and the nurse who deals with her is on holiday until the end of September so I cannot get a letter from her to say that she needs a home assessment and the HAAS have said if she does not attend the assessment her benefit will stop. I have requested a call back from a manager at HAAS but as per when it was run by ATOS no call has been received, they may not be ATOS but they still have the ATOS attitude. Any suggestions please.

An ESA50 should be issued for every re-assessment, your post suggests that this has not happened as the last ESA50 appears to have been in 2012 and was followed by an assessment and I assume Decision in 2013.

It does not matter that the prognosis from the assessor was only for 12 months as this period is not part of the Decision and the DWP are not bound by it as they can re-assess a claim at any time after three months have elapsed from the previous Decision.

I'm afraid if Maximus do not offer a home assessments themselves then you will only get one by presenting additional medical evidence that shows that she cannot attend, a GP's letter may achieve this. The decision to allow a home assessment lies solely with Maximus and is not an appealable Decision, the only other thing I can suggest is to try contacting your daughter's MP.

Contacting your MP

Claimants are allowed two opportunities to attend an assessment, if they fail to attend then Maximus will return your daughters file to the DWP, they should contact her as to why she has not attended, if they do not accept her reasons then they will close her claim, although this is an appealable Decision.
