free prescriptions on esa

ive been disabled for many many years due to been misdiagnosed by my doc,injured my spine at work blah blah I have been on incapsity benefit then dla middle rate,im currently on esa contribution and just been fined by the nhs for not qualifying anymore.why can the income related part can get free medication and the contribution one cant, I worked my ass of and paid shed loads of tax and ni,now since my income support has been merged im not entitled too any help....

I'm afraid, as you have found out, only claimants receiving an Income Related benefit are entitled to free prescriptions and dental care.
Have you checked whether you would be entitled to an Income Related ESA top-up to your current ESA(CB) payments, try putting your information into one of the online benefit calculators, if you are then it should be back dated and you would be able to get the fines back.

If you are eligible, then you need to contact the DWP for an ESA3 form.

Hi HN,
Income Related (IR) benefits such as IR ESA are the equivalent to receiving Income Support (IS)
People in receipt of Contribution Based (CB) ESA may also be entitled to an IR ESA top-up to their CB ESA, just as claimants previously in receipt of Incapacity Benefit (IB) (A contributory benefit) may also have had entitlement to an IS top-up.
Hence Gordon's advice to check your entitlement for payment of any IR ESA top-ups.
You only need to be entitled to payment of a penny of IR ESA (the same went for IS) to be passported to free prescriptions, dental care, etc, etc.
Unfortunately, the Government deem that if you are not entitled to payment of IS or an IR benefit that you have no automatic exemption from prescriptions charges :
