hi good evening, i am writing on behalf of my father in law, he is 66, he has severe copd which he has had for 3+ years, and recently had 3 mini strokes, i along with our welfare rights team applied for a/a in august this year, he received a phonecall today advising him he has been awarded low rate attendance allowance but this will only start from january 2016, plus they no longer backdate claims? i wasnt there when he received the call but i dont think it sounds right?? any info would be great!! thanks

There should be no reason why a claim for Attendance Allowance should not start from the date that the claim was made, unless the claimant did not meet the criteria on the day of their claim, but was judged to meet it a later date, in which case the Effective Date of the Decision would be from when they met the criteria.
I notice your father in law had the support of Welfare Rights, I would suggest that he contact them about the problem so that they can investigate.

thanks for the reply gordon... the lady told him they have dismissed his copd and are only using the strokes for his claim which is why he will only recieve payments from jan as this would be 6 months on from the strokes! will wait for his paperwork to come through then will maybe ask them to re-look at it...
