  			 				Hi all,
just another daft? question.
 
Is there anyone out there that have had the MR, failed and decided to appeal to a tribunal hearing?
If you have, how long from the MR decision to the tribunal?
 
I'm asking because it's a decision we may have to make if we proceed to MR but if all goes wrong then wife could loose what little she was left with after a savage F2F assessment until the tribunal hearing.
I have heard that the tribunal hearing once lodged and accepted should be taken within 3 months otherwise it would constitute a breach of your human rights! Is this actually true?
On saying that and from past experience, our last one took over a year.

I'm afraid there is no time limit within which an appeal must be heard and it is certainly not a breach of your Human Rights if it is not held within a given timescale.
 
Typical appeal times are about three months but there are regional variations.
 
If other members can post how long they waited, we're happy to approve their posts.

  			 				My MR was rejected 29 April, practically by return of post, and my appeal tribunal was today (in Lancaster).
 
So that's a six month wait.
 
I didn't have any award to lose though (nil points).
 
I previously got DLA low rate care, and applied for PIP April 2014, with the consultation in March this year. I'll post my result elsewhere when I get it.
