I have been asked to represent someone at an Upper Tribunal appeal on this issue. A bit out of my league to be honest!

This sounds difficult for someone not experienced in the law.
I have found the judgements which I'm sure you have.
The advice with the judgements says to use the beneficial one and ask the tribunal to use it too.
If they don't you need to go to judicial review to get clarification.
This issue has to be resolved in my opinion but without legal aid how will it happen?
