PIP Tribunal was created by Huma
I have recently been put into ESA support group after one off medical assessment, mainly for fibromyalgia, mental health and back pain. I failed PIP medical assessment in the summer, and going to tribunal next Tuesday. This will be for my back and mental health issue of which welfare advisor told me I have enough evidence. I have just been told that at a tribunal, for PIP, a nurse/doctor, could overturn my ESA award if they so choose to! I thought these were two separate benefits? Is this a new practice? Not sure if I should go to my PIP tribunal now.

They are seperate benefits.
I would have thought that if you failed PIP then the DWP could review your ESa but I don't think they can stop ESA if you fail PIP. It is a completely different benefit with different rules and criteria.

Furthermore, the Tribunal Service are independent of DWP, it is entirely possible that there will not even be a representative of DWP there on the day.
Nothing on this board constitutes legal advice - always consult a professional about specific problems
