On DLA condition worse and claiming PIP was created by Bamboozal
Hi am needing some help on what to do next please...

My father has claimed DLA for the last 10 yr due to epilepsy caused by a brain injury, he was awarded middle rate care and low rate mobility.

3 yrs ago he had an epileptic stroke affecting his ability to walk etc and never recovered
fully but we didn't get in touch with DLA to inform of his condition worsening due to the stress of applying. He's in the support group of ESA. Recently his condition has deteriorated and after physio she said he shouldn't go out with his wheeled walker on his own for safety.

My question is how do we ask for a supersession do we fill in a new PIP form to apply for enhanced care and mobility as DLA doesn't exist now? or do we call DLA and tell them?
And the fact that he can't go out on his own or go out and walk without a walker with someone
meet the 20 m rule? He also can't get in and out of taxis as he falls

I know we should have sorted this a long time ago but were frightened of him loosing his award

You don't say how old your father is? If he was under the age of 65 on 8 April 2013, then reporting a Change of Circumstances will result in an invitation to claim PIP, if he was 65 or over on this date the it will be a DLA re-assessment.

If it is a DLA re-assessment then he cannot receive an increased award of DLA Mobility unless you can show that he met the criteria before the age of 65, however, this may be a problem if you did not report the change at the time, especially as this would now be more than 2 1/2 years ago.

If it is a PIP transfer then you will need to show that he cannot reliably, on the majority of days walk more than 20m either with an aid or without one.

Reporting a change will open his whole award to scrutiny, this is particularly the case for PIP which has different criteria and a fundamentally different assessment approach, so there is no guarantee that he will receive the same award.

If you decide to go ahead then you should notify the DWP in writing of the change and then go from there.

Hi Gordon,

He is 64 now so would be under the 65 in 2013.

His initial award was for uncontrolled epilepsy alone, but after his stroke is so heavily medicated
that he slurs his words and relies on care 24/7, this wasn't the case when he was initally awarded DLA, at the moment he is unable to walk at all due to cellulitis so that is why we thought we had better address his DLA award.

If I ring DLA to ask the procedure would I still have to write in beforehand?

You should write and report the change of circumstances.
