Hi to everyone :), this is my first post so I hope I am in the right place.
I have appealed against the PIP decision on the basis that they seem to think I can work miracles whilst lying down.

Anyway the assessor has written all sorts of things that quite Simply are not true.
He did no examination telling me that he wasn't going to ask me to try and stand as he did not fancy picking me up off the floor! Also that having no ankle reflex does not bode well for trying to walk.
He wrote that ' I said I walked the 30 meters to my car!' I said no such thing! for a start I can't walk that far on the flat and I would have a step to negotiate and an uneven path. I had told him I don't drive anymore due to pain and he has written that too so contradicted himself. I had told him that to go anywhere, I need to be in my chair but sitting up is so painful I can't go far anyway.
So basically he lied on the forms for dwp by saying during the examination I did so and so, when I didn't have an examination and if I had I wouldn't have been able to do those things. Based on this he has made recommendations for using various aids. The whole report is flawed.
I have been on higher rate mobility and care for the last 5 years having won one tribunal already a few years ago. They kept putting it down for review every 18 months or so saying that time and or treatment might improve my symptoms . There is no treatment and the nerve damage is permanent, and has been since the first 8 months that they made me wait for the disc operation.

As yet I don't have a date for tribunal I only received all the papers last week. I am after advice about writing a submission possibly? or what to do next please

Hi Catsinc

You need to read through the PIP Appeal guide in the members area, accessible through the menu down the lefthand side of any page of the website.
You will have to request a Mandatory Reconsideration first. This virtually always rubberstamps the decision and you will have to appeal for an independent tribunal hearing next. This is all explained in the guide.
You will need to go through the reports from the decision maker and assessor, picking out all the lies, explaining what you believe to be the truth and using your supporting evidence to show where you believe you should have scored more points.
You have 28 dats to lodge your request for MR. You can ring and lodge it but you should follow it up in writing as they can 'forget' or 'lose' phone calls.

Hi I have already done MR and it came back the same quoting what I so called said and what my imaginary examination and observations were. I have now had all the papers for tribunal.
Having read the appeal posts I think I should make a submission? Am I correct in thinking it is basically doing what you said to do for the MR? Ie picking out the lies he told infact the complete opposites to what I said.
Should I go for the fact the assessment was flawed and to discredit it? I think I read that somewhere . or to pull up each individual point that was dreamed up or lies? There are at least 4 covering mobility and daily living.
Sorry to drone on but I am confused as to which is the correct/best track to take.

Hi

It is best not to get involved in slagging off the report and/or assessor.
You need to pick apart every wrong thing, explain the truth and use your evidence to challenge what is in the report. Obviously this ends up discrediting the assessor anyway but is better than just saying the assessor was a liar and put down things I didn't say. Its just a case of phrasing it right.
This would be in the form of a statement so basically the same as the MR.
You will probably be best going to,the hearing in front of the panel and naswering any questions they amy have. Hopefully you have someone who can go to the hearing with you?
