Aspie daughter's PIP denied was created by ELEANOR
My daughter received the letter yesterday telling her her claim had been denied. I have been through the appeal process myself so I am confident we have good grounds. What I am wondering is this: is it a good idea for me to take her to our GP and show him what the assessor's reasons were and ask for a letter of support from him to send with the Mandatory Reconsideration? He has known her all her life (she is 21) and knows how her depression and anxiety affect her. The assessor said she showed no signs of anxiety at the assessment and, because she refuses to take medication, that will also have gone against her. With her Asperger's she is entitled to lower rate mobility component as she cannot plan and undertake a journey to a place with which she is unfamiliar but the assessor disregarded that. She cannot manage complex financial decisions but the assessor decided this was not true as she said she had a debit card.
Also, does she have to phone to ask for a mandatory reconsideration? She is phobic about using the phone but, if this is absolutely necessary, I will at least be with her when she makes the call as she is at home from university for the Christmas holidays.

Hi

It would be excellent if your GP will go through the decision with you and write a letter refuting the points made by the assessor.
You can request the MR in writing. This is actually best as the DWP seem to ignore or forget phone calls.

Beware ---one's past and recent experience is that DWP will not respond even to recorded delivery letters. May need to contact MP.

It would be premature to do so now. I have successfully contested my own PIP denial in the past and had no problems with the post. I never send letters by recorded delivery; my husband once sent a job application by this means to a local government department. There was no-one on the premises to sign for it when it was delivered so the postman took it back to the depot. After 14 days it was returned to my husband. I keep copies of everything I post and receipts so that I can prove that I posted the information on a certain day.

MR = Mandatory Reconsideration, the first step of the appeals process introduced by the government to try to stem the flood of appeals. Usually just rubberstamps the first decision.
