Dla stopped was created by louise
Hi
first time posting ,my sister has severe mental health issues and was on low rate DLA. She has worsened tremendously in last 3 years so decided to apply for pip , initially phoning in august after sister was admitted to hospital (I live abroad and need to come over regularly to help with problems...).Form was sent but sister spilt coffee all over it so I had to get it resent to her then she sent to me abroad to fill in... to cut a long story short it was filled in on 20th October.
I did call dwp to inform of delays but they did not tell me benefit would be stopped.
Now the application is with ATOS..who are trying to contact her psychiatric nurse.
Today we checked her building society account only to find dla was stopped in August.
How can I get it reinstated?
Many thanks for advice I feel so stressed trying to do things from abroad and she has no friends or family

It's difficult to advise without more information, but if her DLA is not in payment then this is most likely because her original PIP2 form was not returned in time, this would seem to be consistent with her DLA stopping in August and the form not actually being returned to the DWP until October.
Claimants are given four weeks to complete and return the form and whilst they can ask for an extension, but even if this was done it would be for extra weeks not months.
Failing to return the PIP2 form will result in the PIP claim being closed and as a result the DLA one as well.
You can try requesting a Mandatory Reconsideration of the Decision to close the claims, you will need to explain why the request is late and the DWP do not have to accept your reasons, if they do not then you cannot pursue the matter further. Given the delays, you may struggle to prove your case, but you lose nothing by trying as the DLA cannot be re-instated unless the DWP revise their Decision.
If this is not what happened then you need to provide more information and we will do our best to help.
