  			 				Hi, ist ever Bw forum question !!!
I have been refused a home visit twice by atos even after a doctors letter and a threat of legal action on the basis of "reasonable adjustments" under EA 2010 ... I really am not fit for travel - I have a very rare condition (mesenteric panniculitus) opiate semi controlled pain and im not in control of my bowel movements - I have severe diabetic neuropathy and have not left my house in over 6 months - as well as severe mental health conditions of BPD , AGORAPHOBIA + ANXIETY / SEVERE DEPRESSION - I have a CPN . I have made formal complaints to ATOS and DWP over the bullying tactics of ATOS phone calls - which caused me to swear at them and put the phone down telling them to stuff there appointment.
any suggestions on how to force ATOS into home visit ? they did offer me a "PAPER ONLY" DECISION - but now seem to want to force me to attend - by threatening my dla / pip will be stopped if I don't conform.

Your options are limited, the Decision to allow a home assessment lies wholly with the Assessment Provider (AP) and is not an appealable Decision and although they may be in contravention of the Equality Act, this is only something that could be pursued after the event.
 
If you fail to attend then DWP policy is for the AP to return your file to the DWP who should then contact you for your reasons for not attending, if they do not accept these then your claim can be closed and as a consequence any DLA claim as well.
