Hi all
This is my 3rd post about this topic ,I do hope someone can help
So my daughter has been classed as disabled for about 5 years now was DLA now enhanced living PIP. She is 19 and was attending college, She has now decided to leave as she cannot cope.
I have been told that she is eligible for ESA we are currently going through the process fit note etc.
What I would like to know is. As she is entitled to 3 months backdated ESA payments ( if we can get a fit note backdated) Will the fact that during those 3 months I was claiming Child Tax Credits for her effect the backdated award for ESA
I spoke to someone earlier today on the TC helpline to cancel my CTC award as my daughter is leaving college and he seemed to think it shouldn't as my daughter is now claiming benefits in her own right with her own NI number.
Please could someone offer some advice its all so confusing

I'm afraid we do not deal with Tax Credits on the forum.
I see now reason why your Tax Credits will effect your daughters claim for ESA, however her ESA claim may effect your claim for Tax Credits, all I can suggest is that you contact HMRC about the matter,

I don't think you will get the ESA backdated as you can't be claiming child tax credits at same time as ESA. If you look at tax credits award notice it mentions children claiming benefits in their own right.

Yes I understood that but it still stands that Paula cannot have tax credits for a child that has claimed benefits in their own right.

Hi Rh,
I am afraid that the comments regarding Tax Credits are not within the Forum's remit.
It takes the Mods all their time to keep up with all the DLA, PIP and ESA queries.
Members need to take on-board that we are not a 24/7 personal general benefits advice service, we never could be.
Subs are paid to access the Members Only Guides on AA, DLA, PIP and ESA. and the Mods volunteer in an effort to complement and help with the Guides.
However, Mods very often go above and beyond their remit in trying to help members.
The Forum is provided as a "courtesy" to members !
