Can you clarify :The PIP MR guide.
Here is the scenario.

Happy with rate of both components awarded

Not happy with length of award.


Asking for a MR to look at Length Of Award Only.
Or is the DM allowed to also bring the awarded components into question.

I have given this query it's own new topic, as it is regarding PIP not ESA !

Please pose any further PIP queries to this topic.

As the length of a fixed term PIP award legally forms part of the award as a whole, requesting an MR of the length of the award could also lead to DWP re-looking at your actual PIP awards and whether you still qualify for them from scratch.

Although, PIP awards are generally reviewed a year before the end date, PIP Legislation dictates that all PIP awards can be reviewed at any time for any reason !!

This ruling simply clarifies that the length of a PIP Award can be appealed.

However, as previously advised, : PIP Regulation 11. allows DWP to review/re-determine any PIP Award, at any time, for any reason, see :

"Re-determination of ability to carry out activities

11. Where it has been determined that C has limited ability or severely limited ability to carry out either or both daily living activities or mobility activities, the Secretary of State may, for any reason and at any time, determine afresh in accordance with regulation 4 whether C continues to have such limited ability or severely limited ability. "

Therefore, there would be nothing to stop DWP reviewing your PIP awards in their entirety if they wished to, even if you only requested an MR of the length of the award.

PIP Reg 11, is just like "The Sword of Damocles" constantly hanging over all PIP awards !!
