Equality discrimination PIP recording restrictions

Hi, does anyone know if the DWP have been taken to the Equality Commission for disability discrimination for the restrictions they place on PIP recordings that are not placed on ESA recordings

I'm not aware of any such claim, but I'm not sure on what basis one would be made.

Claimants have no legal right to require the assessment is recorded.

When the DWP looked at providing recording facilities for PIP, the take up for ESA was so low that they took the view that there was in fact no significant requirement.

Claimants can provide the recording facilities themselves, the requirements are the same as for ESA.

Hi Gordon - at an ESA interview in 2012 for my partner, this was recorded by the assessor on equipment they provided. Do those attending ESA assessments now also have to produce their own equipment as well - it just seems an unfair, discriminatory and unacheivable barrier to have to overcome ... Issie

I have been to three assessments over the past three years two unrecorded, the HCP's report bore no resemblance to what was actually said. Nil points for ESA for wife in Support Group on appeal and complaint to NMC about the HCP (a Nurse). Second unrecorded Pip for son nil points .currently awaiting FTT appeal decision.

The one recorded on ESA HCP report had over twenty points for son into WRAG.

The low take up for ESA FftoF due to very few people knowing or told about recording by DWP

The specified equipment is too expensive for the average PIP applicant but would be a fairly cheap purchase for organization who send Advisers to accompany vulnerable claimants at FtoF on a regular basis

this advice note on the govt website says that those attending an ESA WCA assessment can have it recorded EITHER with equipment provided for them OR they can provide their own equipment themselves subject to DWP specifications,

If such a provision is not available to those attending a PIP assessment is this not grounds for a case of disability discrimination. Some people may attend both an ESA and a PIP assessment but they can only record one. - would welcome your thoughts ... Issie
