If you have missed two appointments for an assessment then there is a real possibility that Maximus will now return your file to the DWP as a no show and this may result in your claim being closed. If they are considering this then the DWP should write to you for an explanation of why you have failed to attend.

Your post suggest that you are still in the Assessment phase but you also say that you have been told that you have been moved to the Support Group! If you are unsure of your status then you need to contact the DWP office dealing with your claim.

ESA: 0345 608 8545 Press Option 3 for ESA. (Open 8AM-6PM. Mon-Fri.)

Without knowing what you current status is I'm afraid we cannot offer any advice with regard to your making a complaint.

Can I ask why you were speaking to the Decision Maker and are you sure it was a DM? :)

It's not ATOS who are doing the assessments for ESA now, it's been Maximus since early last year.

Have you had an ESA50? Even if you have returned one you might want to have a look at the following.

Invited to a face to face assessment but no ESA50 sent

I would hang off making a claim for maladministration until you have been assessed.

Because in another group they said if u been lost to email ur area managerand her office forwarded my email n case to dm andhe'd be ringing all day urgently on private.but i'm too scared and then i did answer once late n he tell me himlooking for me all day. he was so nice on the phone i thought he wanted help me. i do feel conned and fooled. i sent him all my evidencefrom specialist which i already sent dwp along with previous fit notes.

he said hed do all to get atos to move me to sg

then he must have changedmind because i got told 3 weeks laterbooked an appointment f2f nhe had spoke me daybefore but he was to guilty to say it. atos to;d me that decision to f2f had been made daybefore so dm betrayed me.

i thought he was working to be mycase worker but hemakes it worse now...... i did get him to do things at dwp for me but then hestart giving me tests i do feel groomed because he told me to do things that i already said in esa50 is difficult without damaging myself. for example make calls my carer said he assessing me on descriptor now i told my carrer she said dont contact himnomore but he got me cause he said hed do everything for meand know wwhat difficult and destroyed ive been n personal circumstances i hada lot of court help for seperate issue. he took my trust just like that.

I'm not sure what the Decision Maker thought they were doing when they spoke to you, they certainly should have not said anything about trying to put you in the Support Group, even though it is the DM that makes the Decision, they have no medical training and cannot make any Decision without the support of a medical report.

I would recommend that you contact your MP to see if they can arrange for an assessment to be made by Maximus. See

Contacting your MP

Unless your conditions have remained stable since you completed the ESA50 you should seriously consider completing a new one.
