Does getting married affect ESA/PIP for either per was created by philippajanebrown
My friend is in receipt of ESA(Support Group) & DLA and her boyfriend receives ESA (SG). Will their benefits be affected should they marry?

Getting married will not affect the DLA payments, but it "may" affect their ESA payments.

If they are both being paid Contribution Based (CB) only, where no part of their ESA is Income Related (IR) ESA, they should be able to continue with their own individual ESA claims after marriage. (They would still have to inform ESA and DLA in writing)

If any part of their ESA payments is IR ESA, then as IR ESA for a couple is paid at a couple rate, rather than for two individuals they could lose money.

Further, if your friend is receiving The Severe Disability Premium (SDP) as an : Income Related (IR) ESA Premium top up due to being in receipt of a Middle or Higher Rate Care DLA award, she may lose that, as she would no longer be classed as living alone unless her husband also receives a MR/HR Care DLA award or a PIP Daily Living Award.

There is also The EDP to consider, if one or both of them are in receipt of that for being in The SG, as that is paid as IR ESA at a couple rate for couples.

As you may gather, this is not a straightforward issue and not something that can be advised properly upon through a forum.

They need to contact CAB or the like to gain proper face to face advice and a "benefits check" !!
