My husband has his first ESA assessment next week. Four years ago he was put in Support group based on evidence so didn't have a face to face. He's really worried, as when he had an assessment for IIB some things he said were distorted or misconstrued and he had to appeal (which he won). He's thinking of phoning and asking for the ESA assessment to be recorded. Has anyone found this to make any difference? Has it helped in an appeal?

Hi Aurora,

Yes, if your husband wants his assessment to be recorded this he must arrange it ahead of time. So, with little time left, a phone call is needed. Please note that DWP have said the claimant does not have the right to cancel if they turn up and discover that recording has not been arranged.

It is impossible to know how an assessment might have been conducted if it had/had not been recorded. However, there are enough claimants saying that the assessor's report bears no relation to what happened, so many people feel happier with recording.

Covert recording by the claimant is legal - but it is likely that the assessment would be terminated, and file returned to DWP, if it were detected.

I am not aware of any incidence of the recording being used at appeal.
