Care Contributions - ESA /DLA, how treated?

Can anyone tell me what (and where) in the Care Act 2014, describes the things and or formula LAs must/must not consider when calculating a young adult's Contribution towads any care package.

I'm particularly incensed by our LA's assertion that no amont for an annual holiday is included in the calculation of 'allowable' (or disregarded) expenses.

Mrs. Hurtyback explained in answer to a previous post that ESA is meant to cover those things a wage would.

I'd also like to know what things, under this administration, ESA is expected to cover?

This is not an area of benefits that we advise on so I have to suggest that you get face to face advice about the issue.

Allowable expenses are those items required for the care of the claimant, this might include aids and appliances or treatment not covered by the NHS.

You would need to show that any holiday was for therapeutic purposes, this would likely need confirmation from the claimants GP.

It's really got nothing to do with ESA being in payment, the situation would be the same if they were not receiving benefit or they were working.
