Last Friday I received the outcome of my assessment, Since 1998 after being medically retired after 24years service because of injuries I'd received in the service of this country plus, Several Medical Boards they concluded I was 80% disabled?
Jumping forward to 2012, although I receive no other benefits other than DLA the DWP got it into its head I deserved another medical their representative, threatened they d have my old age pension withdrawn if I did not attend?
April of 2012 I went to a ATOS centre to be informed that I was in receipt of benefits? (News to me ) I went through the examination with the Doctor? Asked at the end what points I needed to be considered disabled 14 came the reply " What's my score on the door doc" oh 23points? And I still don't receive help because of a inadequate medical pension?
Know here's the crux of my writing, I am a mug why you may ask, my health since 2012 has deteriorated I am unable to dress without help, unable to prepare food as I drop item that contain hot or cold water, I cannot parr because I cannot feel my fingers and we were beginning to have as much human flesh in our veg as your good old five a day, I find it difficult to use public transport due to the brain damage caused in the 90s, and the pain and breathlessness is so bad after 15/16 meters I have to stop recuperate for several minutes move on!
Now here's the woozy, I was assessed 7weeks ago and since reading the decision they're assessment in this humble mans assessment is not fit for purpose? I've lost my mobility component on two grounds firstly I walk to far (apparently it doesn't matter that it takes me an hour to walk to the end of our road and back (a very small cul-de-sac) and I stop to recover by resting on my sticks? Every 15 to 16m
Oh and here's the cu de gar I LOST the mobility component because I walk with my dog for company (she's my constant companion 24/7) as my wife has to work part time so we can survive ? And the other 18 hours of the day looks after me? Am I not allowed fresh air or is it now rationed if your disabled? Do I ignore government and consultants advice to exercise when I can?
Finally in their decision they've missed out one major fact? Between Mid-February and my assessment I'd fallen several times and on three occasions torn ligament's and tendons in my left lower leg? and had not walk my dog from February until my assessment the reason I mentioned walking the dog was which was either missed or I forgot was in the past tense not the present...but the DWP assessor came to the conclusion I can walk safely without assistance? WHAT ? But they know better than MOs, GPs and Consultants?

I assume you were invited to claim PIP as a replacement for your DLA award.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process and template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Thanks Gordon good advice I've come up with over 10 errors and three comments that are totally untrue she even ticket a box that she had my consent how could she when she relates to many areas that were covert observations and gullible me I never realised even though until 2012 for 14years I worked as a child therapist
I tried during the interview and review not to come from a place of anger?

Try and stick to issues that relate to your scoring points, for example the issue of consent may be a matter for a complaint but it is unlikely to score you points.
