Oh my goodness - I wasn't aware of the situation regarding volunteering work... I naively thought it was ok for him to work voluntary if he wasn't getting paid!!! Have you any idea what will happen if this is the point they are picking up on?? Can they penalise him even if no money was received?
I also looked at the ESA award letter we received and to my horror it states they have used the tax years ending 5/4/2014 to 5/4/2015 which means he was over the £6000 savings allowed at that date. When I filled in the claim on 26/5/16 his savings was under the £6000? Have you any idea how they will deal with that?
I really don't understand any of this but I would like to have as much information as possible when I go with him to the interview, as my son will be unable to answer any of these queries!!!

I think it unlikely that it was the voluntary work as there would be nothing obvious for the DWP to pick up on, he won't be on payroll so they would have no visibility of him doing this, it is more likely the cashing of the ISA.

The Tax Years refer to his National Insurance Contributions, if any/

If it is the ISA then they will want to understand what has happened to the money to ensure that it has not disappeared to allow him to claim a benefit.

Buying a car should be accepted as a reasonable expenditure.

I don't suppose it really matters but the money which was in my son's name was built up during the years from a monthly standing order from our account which can be proven via our bank statements, and was being saved for precisely the reason to help him get a car.... Whether the DWP will agree with this is another matter.
My poor son has only been in receipt of the ESA since February (hasn't been to his f 2 f yet) and we're already getting grief.
As I have said I have had no dealings with the DWP in my life before, and receiving this letter is making me feel like a criminal!!

Part of the problem is that you are acting on his behalf but are not recognised as his appointee and so the DWP will be assuming that it he that is making the decisions.

How do I go about becoming an appointee for my son? As I have said he although he doesn't have severe learning disabilities he doesn't understand how to respond to questioning nor understand how to fill in forms etc... Therefore I need to do all this on his behalf.
I think probably I would be better getting a Power of Attorney?

You can apply for POA online, it is quite a simple process.

I don't think you have to hold POA in order to be an appointee. Even if you do have POA, you still have to apply to DWP re being appointee. I think they would want to come out and see your son. This might sound overly officious but DWP have a duty to make sure you, and they, are acting in the best interests of your son.
