I have Fibromyalgia, chronic back pain and depression. I have been on ESA in a support group since 2013. I went in June to a ESA review by Maximus. The outcome was a refusal and i am currently on JSA. The jobcentre have been great and told me to get a sick note whilst my appeal went through. My appeal was refused and the DWP cancelled my sick note. How is this legal?? How can a nurse who saw me for 30 minutes know more about my health problems than my own GP. I now have to get another sick note (will they cancel that too) and go to the tribunal. From losing my ESA i am already down £168 a month. Will they take my PIP too? I volunteer 1 day a week, it gives me a purpose in life. I don't always get there but i try my best. I told the Jobcentre i could possibly work 2 mornings 8 hours a week. I have to look for 16 hours a week over 5 consecutive days with 90 minutes travelling each way. They may as well ask me to fly to the moon. Any advice would be appreciated.

Just to clarify, you were found Fit for Work, you have requested a Mandatory Reconsideration which upheld the original Decision and you now have the option of going to appeal, is this correct?

On the assumption that the above is correct the you can now make an appeal to the Tribunal Service, have a look at the ESA Appeal guide, it contains links to the SSCS1 form that you will need to complete and instructions on how to do so. See

Once your appeal has been accepted and the DWP have received notification, then you can contact the DWP to be placed on the ESA Assessment rate while you wait for a hearing.
