Well today it happened,I was called by my husband to come home (I was in a NHS meeting)
My daughter had received her PIP results, we had to calk a Dr. I am sure she is in such a state that her mental health has broken. She has been denied help,will lose car and payment.Her home had been assessed for alterations, she has not had a bath or shower for months because she has not the mobility, she cannot even get out of the house unless someone is with her. For 10 yrs she has had Fibromyalgia,Arthritis,IBS and more is on morphine constantly and exists in a wheel chair, her husband has to prepare all the food she cannot manage it.
The report says she is overweight?well she cannot walk anywhere, she had taken more pain killers because we had a 2 hour drive for the assessment. LOL grip my hands, raise your kness 2" I can see you will not get on the bed. I kept an account all through the assessment.
After we got home she was in bed for 2 days with fatigue and exhaustion. I am at the moment trying to sort out the "Mandatory" appeal. I am so confused now, but thanks for the guides. How I wish that all those in Government could live with someone for a week to really see the stress and pain that is caused. I work for a Mental Health Trust and they are seeing their figures rise yearly Thanks for listening to me, I feel my heart has been broken today

I really sorry to hear this.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with her claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that she met the criteria, there are many reasons she may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that she walked 50m, she did but they have failed to document that she had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.
