Hi...I was awarded daily living at the enhanced rate and standard mobility until February 2017.
I Received my form to fill out on the 7th June 2016. My daughter rang them up and told them I was going into hospital on the 20th June for an operation and should we wait to fill it out.
She was advised that she had to ring up when I went in hospital and to ring again when I have been discharged. The form had to be posted and received in the office by the 7th July.
I was kept in hospital for a full 7 day's. This meant I had 9 day's to get this form filled in and posted whilst still convalescing.
My disabilities, illnesses etc have not altered from my last assessment in anyway of which I had in my home and was a thorough assessment too.
By the 26th July I was called into my assessment just 3 miles from my home of which I attended with my daughter.by taxi. Everything seemed rushed including the assessment and I still had to go for my follow up. (I showed this evidence too)
The outcome was devastating. i found out when my daughter was checking my direct debits that my PIPs payment had dropped by £200. This was confirmed later in the brown envelope letter. I am so stressed about the whole situation and when I see the letter I have to put it down. My Enhanced was dropped to standard and mobility scrapped. I don't know what I have done different apart from rush to get it back in and maybe not come across clearly.
Please can anyone advise any help. Thanks. :blink:

Really sorry to hear this.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

www.benefitsandwork.co.uk/help-for-claimants/pip

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

When you have a better idea of the issues with your claim, come back to the forum and we will do our best to help.
