Having the same medical assessor again .. was created by 0124katee
Can anyone tell me if I go to a medical assessment and find the health professional doing it has done my assessment the previous time , and resulted in my failing the capability for work and ending up almost going to tribunal to get reinstated, thank s to help from Benefits and Work website ! I managed it ...
Well today she said to me " you've had me before , do you mind having me again .?"
I really felt yes , but daren't say as had been waiting over 40 mins in waiting room. As it was , I had friend coming to fetch me at 11 am .. I didn't know what procedure was if I said Yes , I didn't know if meant a further long wait or it being deferred till another day ?
Please enlighten me or let me know if it explains protocol in the guides for members anywhere , thanks

Nothing on this board constitutes legal advice - always consult a professional about specific problems

If you have had the assessment then the question is really moot!
There is nothing in the DWP guidance to assessors that covers this, if you had made a formal complaint about the assessor, then I think it would be reasonable for you to refuse to be seen by them again, if you did not then the situation is less clear and I would be hesitant to ask for a different assessor unless it was your first appointment and you had a fall back to a second appointment, my worry would be that you would be treated as failing to participate.

Thank you Gordon for your comments ..
It was a first appointment , and I had seen this lady nurse before three years ago .. But I had waited ages and I didn't know what would happen if I said yes , I suppose they would have maybe given me another appointment , but thought maybe it would have gone against me .. Rather unusual I ve never had the same person before till this time ..
Last time I lost the ESA , it's contributory and was in the WRAG, and I went to mandatory reconsideration and tele calls from them and was setting up to go to tribunal, then after Christmas DWP just wrote and had reconsidered and put me in the support group and reinstated me , without the tribunal ... That got cancelled .. I never knew why , I do s little bit of therapeutic work in school they allow that .
Thanks for your reply as I couldn't see it covered anywhere ... Cheers
