Mandatory Reconsideration - refused

Hello

I used the B&W handbook to assist me filling the original claim form in detail. I then had a assessment. The assessor awarded me no points and her evidence was inaccurate and I do not know if she even considered the documentation I sent of my consultant letters and medical history. She did complain there was a lot of paperwork to look through, however. :dry:

I sent in a MR and have received the letter back saying there is no change.

I know I have to fill in the Appeal form now. I am not sure what to write as I feel my original application form and evidence gave enough information. I also found it incredibly stressful to go to the appointment so I am thinking of doing a letter appeal. Could you advise me if I should give a long explanation of why I disagree at this stage or is it better to wait?

You don't identify the benefit but the MR & Appeal guides for both PIP and ESA (in the appropriate sections), explain how to lodge an appeal, although you can write a letter I would recommend that you complete the SSCS1 form in preference, the guides explain how to do this. You do not need to go into detail on the form why you are making the request.

Goodness that sounds good Hello Kitty, do not be alarmed you have received no points as its happening to lots of people including myself going from DLA to PIPS. The assessors want to consider as little as possible, they just want to fail as many people as possible otherwise they will not be kept on by ATOS Capita whoever. Secret recording have confirmed this on youtube.

I have read of many people getting 0 points and then getting 30 points at the appeal.
It is NOT YOU they are doing this to a huge number of people or offering them lower benefits when they know they are entitled to more hoping they just accept it.

Also the MR its very very rare that anyone gets a decision overturned at an MR. Some whistleblowers have said they are designed to fail and send you their reasons in a jumbled up letter to put you off appealing. EVERYTHING IS DESIGNED TO FAIL. They probably will not have taken into account no extra medical stuff, they just look at the Assessors report and 99% of times it goes with what they have said. Like yours mine lied too, you are not alone.

You can put all the reasons together outlined in a a letter with the appeals forms and you can repeat stuff you previously put especially if you think they ignored it. Try to stick to the PROBLEMS of your illness and its affects on you and how it limits you, rather than going into what the DWP wrote refusing for silly reasons. Its your chance to put your side to someone
INDEPENDENT from the DWP.

ALSO : I would STRONGLY ADVISE you to go to the APPEAL in person as these are far more successful and a carer who I know who has been to a few says in this area its about 90%.

Its Quite LIBERATING SENDING THE APPEAL OFF, as I felt as though I had REMOVED IT FROM THE DWPs Control and now the decision is been made by someone else.

Also don't think of judges in robes, its likely to be a room of a few people sat around a table.

If you can get extra medical reports GP etc that deal with the preceptors, tick boxes, that would also help your case. When you go to the appeal there is nothing wrong with been nervous and they will guide you through the process, asking you questions.

The fact that a huge number of appeals is successful is showing cases like yours should have been passed through straight away without all this nonsense.
