Pip appeal? was created by sabrina
I have been traumatised by a pip face to face medical what can I do? I was abused as a child have multiple health problems and I can tell you this took me back to my abuse. He manipulated me and said incorrect things. I stated I needed my husband to cook my meals. He then said if you can butter a slice of bread that's a simple meal. I am an amputee and arm in a sling but he said I can shower myself. I have a shower board over the bath but with my prosthesis off (not waterproof) I can't transfer from perching stool to shower board. What can I do ? I tried to follow your advice but he was too clever and manipulated me. Do I have grounds for an appeal? There are many more instances of his abuse. I have not slept since which is 3 weeks ago

Have you had a Decision on your PIP claim yet?

Have you requested and received a copy of the assessment report? If not then you need to contact the DWP office dealing with your claim and ask for it to be sent to you.

Without a Decision or the report there is little that you can do at the moment.

If you have the assessment report and you feel that the information it contains is inaccurate or does not reflect the information that you provided during the assessment then you can make a complaint to the Assessment Provider. See

www.capita-pip.co.uk/en/complaints.html

www.atoshealthcare.com/pip/after_your_Consultation

If you have not been awarded PIP or the award is not what you expected then you need to look at the next steps and whether you want to pursue them or not.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

When you have a better idea of the issues with your claim, come back to the forum and we will do our best to help.
