Hi I have just been taken off ESA going from 24 points to 0 yet my conditions are worse! This decision has been upheld during the mandatory reconsideration. I am now going to appeal. I am also asking to remain in the assessment phase. I have three questions;
Whilst in the assessment phase will I receive some money from the DWP?
Once in the assessment phase will I have to produce sick notes? Something which I have not had to do for a great number of years.
If I do have to produce a sick note does it explain what to do with it and where to send it?
Once your appeal is accepted by the Tribunal Service and you have received written notice of this you contact the DWP and ask to be placed on the ESA Assessment rate. The DWP need to have received written notice of your appeal as well so you may need to phone back if they have not received it.
In order to receive payment of the Assessment rate you will need to have an active Fit Note on file. If you did not claim JSA after your ESA was stopped then you need it to be from the day after your ESA stopped, if you did claim JSA then it needs to be from the day after you close your claim.
The Fit Notes need to be sent to the DWP that dealt with your ESA claim before it was closed, their address will be on the letter that notified you that your claim was being closed.
