Hello!

I have recently completed my ESA50 form, which I sent back earlier this month.

I haven't heard anything since, until I received a letter from my Doctors surgery today stating that they have received 'paperwork' from ESA, and before releasing the information, they need my signed consent.

My conditions include depression, anxiety, OCD and physical health issues.

The NHS haven't offered me any support, so I rarely have any contact with them - meaning they have minimal information on my conditions or how the affect me.

I've sent additional medical information in my ESA50 form (scans, letters from consultants etc).

Does anyone know why ESA have contacted my doctors surgery, and do I need to be worried?

Should I sign the consent form, or could that somehow work against me?

I know I can make an appointment to view what is being sent, which I think would be the best idea. But would I have any control over what was being sent?

It is likely an ESA113 asking about your problems for this reassessment, whilst this is done rarely it's not an usual thing to happen.

It would be worth asking your GP if they would like to speak to you about your problems before they complete the form.

Hi Gordon!

Thank you so much for getting back to me!

The weird thing is, I sent my ESA50 form back on Januray 6th.

On 11th January I received a letter stating 'we have looked at your claim again following a recent change' and went on to state that I would receive ESA at a rate of £102.15 a week, because of my 'capability for work' - I have been placed in the 'Work Related Activity Group'.

I don't know if this letter is just stating that the ESA rate has changed, or if it is referring to my assessment?

Any ideas?


I presume the ESA113 has already been completed by a GP - but my question is, if I don't agree with what has been written, can I request that a GP of my choice complete the form instead?

The GP I am registered with is incompetent to say the least. The GP who knows the most about my case has left, and I'm now in a position where I'm confident that whoever has completed the form won't be writing in support of my claim - because they have minimal information on my conditions.

Also, if this is not an option, and I refuse to give consent to my medical information being sent to the ESA deparment, will this work against me?

The DWP have just started sending out the annual entitlement letters so it is possible that what you have received is one of these rather than a Decision Letter, the only way that you will know for certain is for you to contact the DWP about it.

AS your practice need you to attend in order to authorise the letter to be sent, I would ask to have sight of it before they return it to the DWP. Ultimately it is down to the doctor to write what they believe to be appropriate but most GP's should be willing to discuss the contents with you if you have reservations about what has been written.

If you refuse permission then it should not count directly against you but, depending on the contents, it could make the difference between you having to have a face to face and not needing one.

Hi Gordon!

Thank you so much for your help!

The letter I received was via my GP Surgery from the Medical Records Department - do I need yo go through them to view the paperwork, or would I be able to see a GP and view the paperwork that way?

Would a GP at the surgery be able to access that document if they didn't complete it?

You should contact the surgery and explain what you want. They might make you an appointment with a GP or they might arrange for the report (or a copy of it) to be made available for you to read.
