I am taking my daughters claim to appeal. Now we are in possession of all the paperwork from DWP we have noticed that the health professional is referring to a previous assessment carried out in 2015. The DWP guidance document for providers carrying out assessments for Personal Independence Payment (which I have downloaded from this sites) states on page 10 - 'The HP’s role is to assess the overall functional effects of the claimant’s health condition or impairment on their everyday life over a 12 month period, using the assessment criteria'. Can anyone give me advice if I can challenge this, after all why make fresh claims if they are going to use evidence from previous claims? Thanks.

It will depend on the form that was sent, if it was an AR1 Review form and you ticked "no change" then it is the DWP's intention that the previous PIP2 should be used in conjunction with the AR1 to decide eligibility.

If you answered that her condition has changed then only the information in and with the AR1 should be used.

If the form was a PIP2 then the previous PIP2 should not be used.

However these rules are no written in stone and there could be circumstances where a referal back to 2015 could be relevent, if you disagree then you need to argue your case specifically in regard to those circumstances.

Thanks Gordon, it was a PIP form I just needed reassurance. We shall be using this as part of our challenge along the lines of … ‘ we note page 10 of the DWP guidance document for assessors is “to assess the overall functional effects of the claimant’s health condition or impairment on their everyday life over a 12 month period” page 124 of the Health Professionals report is referring to a previous assessment carried out in 2015. Where any inference or descriptors (there are 4) have been used based on this comment, they would not be relevant to the circumstances of this claim
